Terms of service

These terms explain how you may use our website and the preparation services we provide. Please read them alongside your engagement agreement, which governs any paid work we do with you.

Last updated: October 18, 2026

In short: Einstein Visa Experts is not a law firm and does not give legal advice. We help you build and present the evidence for your petition. Legal advice, signing and filing are handled by an independent licensed immigration attorney under that attorney's own engagement with you. USCIS alone decides every case.

01Acceptance of these terms

By using this website, booking a consultation or engaging us for services, you agree to these terms of service. If you do not agree, please do not use the website or our services.

When you engage us for paid work, you will also sign an engagement agreement. If anything in that agreement conflicts with these terms, the engagement agreement controls for the work it covers.

02Our services

We provide non-legal preparation services for people pursuing O-1, EB-1 and EB-2 NIW classifications. Depending on your engagement, this can include:

  • Profile building and positioning of your achievements
  • Evidence strategy mapped to the relevant criteria
  • Drafting support for recommendation and expert letters
  • Assembly and preparation of petition materials for attorney review
  • Organization of materials in response to a Request for Evidence

Legal services, including legal advice, eligibility opinions, and the review, signing and filing of petitions, are provided only by independent licensed immigration attorneys. Your partner attorney works under their own engagement agreement with you and exercises their own independent professional judgment. We do not direct or control that judgment.

Nothing on this website, in a consultation, or in our written materials is legal advice, and no attorney-client relationship is created between you and Einstein Visa Experts.

03No guarantee of outcome

U.S. Citizenship and Immigration Services (USCIS) and, where relevant, the Department of State make all decisions on petitions and visas. We cannot and do not guarantee approval, a particular timeline, or that a Request for Evidence will not be issued.

Any assessment we share about the strength of a profile is our good faith view of how your evidence aligns with published criteria. It is not a prediction or promise of how a government officer will decide.

04Your responsibilities

A strong petition depends on accurate evidence. You agree to:

  • Provide information and documents that are accurate, complete and truthful
  • Tell us promptly if any information changes or turns out to be incorrect
  • Review drafts carefully and confirm the facts they contain before they are finalized
  • Obtain any permissions needed to share third-party materials with us
  • Meet the deadlines agreed in your engagement, including any deadline stated in a Request for Evidence

We will not knowingly prepare materials that misstate facts. We may decline or end work if we believe information provided is false or misleading.

05Fees and payment

Fees, payment schedules and refund terms for our services are set out in your engagement agreement. Fees charged by your partner attorney are set in that attorney's separate engagement with you.

Government filing fees and any optional premium processing fees are separate from our fees and are paid as directed by your partner attorney or by USCIS.

06Intellectual property

The content of this website, including text, guides, design and our brand, belongs to Einstein Visa Experts or its licensors. You may read and share it for personal, non-commercial use with attribution, but you may not copy, republish or sell it without our written permission.

You keep ownership of the documents and information you provide. Once paid for as described in your engagement agreement, you may use the final materials we prepare for you in connection with your own immigration matters. Our templates, frameworks and methods remain ours.

07Limitation of liability

This website and its content are provided for general information, as is and as available. To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for decisions made by USCIS, the Department of State or any other government authority.

To the fullest extent permitted by law, our total liability arising from our services is limited to the fees you paid us for the specific services giving rise to the claim. We are not responsible for the legal advice or acts of independent attorneys, who are responsible for their own professional services.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

08Termination

Either party may end an engagement as described in your engagement agreement. We may also suspend or end access to the website or our services if these terms are breached.

Sections that by their nature should continue after termination, including intellectual property, limitation of liability and governing law, will continue to apply.

09Governing law

These terms, and any dispute relating to them or to our services, are governed by the laws of the state stated in your engagement agreement, without regard to its conflict of law rules. Where no engagement agreement applies, we will work with you in good faith to resolve any concern before either party takes formal action.

10Changes to these terms

We may update these terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Material changes will not affect work already underway under a signed engagement agreement unless you agree to them. Continued use of the website after an update means you accept the revised terms.

11Contact us
