How it works

The O-1 visa process, from your record to a filed petition

Six calm, clearly defined steps. You bring the work you have already done. We map it to the criteria, build what is missing, and prepare a petition that an independent licensed immigration attorney reviews, signs and files.

The same process applies to O-1B, EB-1A, EB-1B and EB-2 NIW. Only the standard and the criteria change.

The six steps

What happens, what you provide, what you receive

Every step ends with something concrete in your hands, so you always know where your case stands and what comes next.

  1. Step 1

    Consultation and fit assessment

We learn about your work, your goals and your timeline, then give you an honest first read on which visa fits: O-1A, O-1B, EB-1A, EB-1B or EB-2 NIW. If you need a U.S. employer or agent petitioner for an O-1, we talk through that now.

    You provide

    • Your CV
    • Links to press, publications or portfolio
    • Your timeline and goals

    You receive

    • A recommended visa path
    • A first read against the criteria
    • Clear next steps
  2. Step 2

    Evidence audit against the criteria

We go through your record criterion by criterion. For an O-1A that means the 8 criteria, where at least 3 must be met. Each piece of evidence is rated as strong, needs support, or missing, so you see exactly where your case stands.

    You provide

    • Awards, press and publications
    • Proof of judging or peer review
    • Role and compensation documents

    You receive

    • A written criteria map
    • The strongest criteria to lead with
    • A list of gaps to close
  3. Step 3

Profile building plan for any gaps

If a criterion is close but not yet documented, we plan legitimate ways to strengthen it: judging and peer review roles, published material, speaking, memberships. No pay-to-play awards and no manufactured press. If your record is already strong, this step is short. About profile building →

    You provide

    • Time for chosen activities
    • Introductions where useful
    • Updates as results come in

    You receive

    • A phased, realistic plan
    • Priorities ranked by impact
    • A decision on when to file
  4. Step 4

    Letters and exhibits prepared

We identify the right recommenders, interview them, and draft letters for their review and signature, each mapped to specific criteria. Exhibits are indexed, translated where needed, and organized so the officer can follow one consistent story. About evidence and letters →

    You provide

    • Names of potential recommenders
    • Original documents and records
    • Review of drafts for accuracy

    You receive

    • Signed recommendation letters
    • An indexed exhibit set
    • A consistent case narrative
  5. Step 5

Petition drafted and reviewed by your partner attorney

We draft the petition letter that ties every exhibit to the standard. Your partner attorney, an independent licensed immigration attorney, reviews the full package, requests any changes, and is responsible for the legal filing.

    You provide

    • Final review of facts and dates
    • Forms and personal documents
    • Petitioner details, for O-1 or EB-1B

    You receive

    • A complete petition package
    • Attorney review and sign-off
    • A filing-ready copy for your records
  6. Step 6

Filing, premium processing and RFE support

Your partner attorney files with USCIS. Premium processing is available for O-1, with a response within 15 business days, and for several green card categories. If USCIS issues a Request for Evidence, we prepare the response with your attorney before the deadline in the notice. About RFE response →

    You provide

    • Your decision on premium processing
    • Any USCIS notices you receive
    • Quick replies if an RFE arrives

    You receive

    • Filing confirmation
    • Status updates as they arrive
    • A full RFE response if needed

Timeline expectations

Preparation is measured in weeks, not days

Most of the time goes into evidence and letters. How long that takes depends on how documented your record already is, and how quickly your recommenders respond.

We share a working schedule after the evidence audit and update it as the case develops. It is a plan, not a guarantee, and USCIS decides every case on its own timeline.

Steps 1 and 2

Assessment and audit

Usually the quickest phase. It moves as fast as you can share your documents.

Step 3

Profile building, if needed

The most variable phase. Some cases skip it, others benefit from waiting until new evidence is in place.

Steps 4 and 5

Letters, exhibits and petition

The core of the work. Recommender availability and attorney review set the pace.

Step 6

Filing and decision

Set by USCIS. With premium processing for O-1, USCIS responds within 15 business days.

Questions

About the process

Straight answers to what people ask most before they start.

How long does preparation take?

Preparation is typically measured in weeks. A well-documented record moves faster; a case that needs profile building or many letters takes longer. We give you a working schedule after the evidence audit.

Do I need everything ready before the consultation?

No. A CV and a few links to press, publications or your portfolio are enough for a useful first read. We collect the full evidence together in step 2.

Who files my petition?

An independent licensed immigration attorney reviews, signs and files it. For an O-1, the petitioner is a U.S. employer or agent; for EB-1A and EB-2 NIW you can self-petition. We prepare the case and work alongside your partner attorney throughout.

What happens if USCIS sends a Request for Evidence?

An RFE is a request for more information, not a denial. We analyze what the officer is asking for, gather new evidence or letters, and prepare the response with your partner attorney before the deadline stated in the notice.
