O-1A visa

The O-1A visa for extraordinary ability in science, business, education and athletics

If you have risen to the top of your field, the O-1A lets you live and work in the United States on the strength of that record. We help you show it clearly: which criteria you meet, what proves them, and how the whole case reads to an officer.

Who it is for

People at the very top of their field

The O-1A is for individuals with sustained national or international acclaim, recognized as part of the small percentage who have risen to the top of their area of work.

Most of the people we work with are further along than they think. The question is rarely whether the achievements exist. It is whether they are documented in a way an officer outside your field can recognize. If you are weighing a green card instead, the EB-1A uses a similar set of criteria for permanent residence.

O-1 visa requirements

The 8 O-1A criteria, in plain language

You qualify by receiving a major, internationally recognized award, or by meeting at least three of these eight criteria. Here is what each one means and the kind of evidence that tends to prove it.

Nationally or internationally recognized awards

Prizes or awards for excellence in your field, where the significance of the award itself can be shown.

Example evidence: an industry award, a competitive research prize or fellowship, with selection criteria and past winners.

Memberships that require outstanding achievement

Associations that admit members based on achievement, judged by recognized experts. Paid or open memberships do not count.

Example evidence: election as a fellow of a professional society, with its bylaws and admission standards.

Published material about you

Coverage in major media, professional or trade publications that is about you and your work, not simply written by you.

Example evidence: a feature profile or interview, with the outlet's circulation or readership documented.

Judging the work of others

Serving as a judge of others' work in your field or a closely related one, individually or on a panel.

Example evidence: peer review invitations, pitch competition or hackathon judging, grant panel service.

Original contributions of major significance

Scientific, scholarly or business contributions that have influenced your field beyond your own team or employer.

Example evidence: expert letters explaining adoption, patents in use, licensing, or work others cite and build on.

Scholarly authorship

Articles you have written in professional journals, trade publications or major media in your field.

Example evidence: peer reviewed papers, conference proceedings, or bylined articles in respected industry outlets.

Critical role at distinguished organizations

A leading or essential role at organizations with a distinguished reputation, where your contribution made a real difference.

Example evidence: letters from leadership, org charts, and proof of the organization's standing in its field.

High salary or remuneration

Pay that is high compared with others in your field and location, shown against reliable benchmarks.

Example evidence: offer letters, tax records or equity terms, compared with published salary survey data.

If a criterion does not readily apply to your occupation, comparable evidence may be submitted instead. We help you decide when that argument is worth making.

How officers read a case

Meet three, then prove the whole picture

Counting criteria is only the first step. Strong petitions are built for the second.

Once the evidence meets at least three criteria, the officer looks at everything together and asks one question: does this record show sustained national or international acclaim, and place this person among the small percentage at the top of the field?

That is why we do not stop at three. We choose the criteria where your evidence is strongest, connect them into one consistent account of your career, and make the significance of each item clear to someone who does not work in your field.

Step 1

Criteria met

Does the evidence satisfy at least three of the eight criteria, or show one major international award?

Step 2

The totality of the evidence

Taken as a whole, does the record show sustained acclaim and a place at the very top of the field? This is where narrative, expert letters and clear exhibits decide the outcome.

Common mistakes

Where strong O-1A cases go wrong

Most weak petitions come from strong people. These are the patterns we see most often, and each one is avoidable.

Listing achievements without explaining significance

An officer may not know why a conference, award or publication matters. Each item needs context: who selects, how competitive it is, and why it stands out.

Spreading thin across every criterion

Claiming all eight with weak evidence invites doubt. Three or four well documented criteria usually make a stronger case.

Letters only from close colleagues

Letters from collaborators help, but independent experts who know your work through its influence carry more weight.

Overlooking the petitioner and itinerary

The O-1A needs a U.S. employer or agent, a clear description of the work you will do, and the supporting contracts. These details deserve as much care as the evidence.

FAQ

O-1A questions, answered

If your question is not here, it is a good one to bring to a consultation.

What is the difference between the O-1A and the EB-1A?

The O-1A is a temporary work visa that needs a U.S. employer or agent as petitioner. The EB-1A is a green card you can petition for yourself, with no job offer or labor certification. The criteria overlap, so evidence built for an O-1A often supports a later EB-1A.

Do I need a major award to qualify?

No. A major, internationally recognized award is one route, but most applicants qualify by meeting at least three of the eight criteria instead.

Can my own startup petition for me?

You cannot petition for yourself, but a U.S. company you founded can act as the employer, or a U.S. agent can file on your behalf. Your partner attorney will advise on the right structure for your situation.

How long can I stay on an O-1A?

The initial stay can be up to three years, tied to the work described in the petition. Extensions are granted in increments of up to one year to continue that work.

How long does it take to prepare a petition?

Preparation is usually measured in weeks and depends on how much evidence is already gathered and how quickly recommenders respond. Once filed, premium processing gives a USCIS response within 15 business days.
